Welcome to CRED Wallet! CRED Wallet is a prepaid instrument issued by Dreampurse Technologies Private Limited.
These terms and conditions ("TnCs") are applicable to your use of 'CRED Wallet' on the CRED mobile application. 'CRED Wallet' is the branding for the Prepaid Payment Instrument issued by Dreampurse Technologies Private Limited (previously 'Hipbar Private Limited'), a private limited company registered under the Companies Act, 2013 having its registered office at 404, Uphar II CHS Ltd. Plot no. 5, BHD Sanjeeva Encl. 7 Bungalows, J P Road, Versova Andheri West, Mumbai, Maharashtra-400061 Vesava, Mumbai, Mumbai, Maharashtra, India, 400061 ("Dreampurse"). Dreampurse is authorized by the Reserve Bank of India ("RBI") to issue and operate prepaid payment instruments in India in accordance with the provisions of the Payment and Settlement Systems Act, 2007 and directions and regulations framed thereunder, as amended from time to time. Dreampurse is a subsidiary of Dreamplug Technologies Private Limited (or "CRED"), and CRED is the company which hosts the CRED mobile application.

All users onboarding onto CRED Wallet shall be deemed to have read, understood, and agreed to be bound by these TnCs.
Eligibility
By accessing and using CRED Wallet, you are representing the following:

(a) You are 21 years of age or older;

(b) You are capable of entering into a legally binding agreement;

(c) You are not barred or otherwise legally prohibited from accessing or using the CRED app, CRED Wallet, or the services offered by Dreampurse;

(d) You are not a 'Politically Exposed Person' resident outside India in terms of the Master Direction - Know your Customer (KYC) Directions, 2016 issued by the Reserve Bank of India ("RBI"), read with the Prevention of Money Laundering Act, 2002 ("KYC Framework");

(e) You confirm that they were born in India, are a tax resident of India, and are not a taxpayer in any other country. Users must provide accurate tax residency details and promptly update Dreampurse if there are any changes to their tax status. Dreampurse may collect, store, and report this information to tax authorities as required under applicable laws. If a user is found to be a taxpayer in any other country or provides incorrect information, their account may be subject to restrictions or termination.; and

(f) You are an existing user of the CRED mobile application, and have read, understood, and agreed to abide by the CRED Terms of Use set out at https://cred.club/terms.

If you allow anyone to use your CRED Wallet, including individuals under 18 years of age, you will still be responsible for ensuring that such individuals comply with these TnCs. You will be responsible for all actions these individuals take in and/or through your CRED Wallet. You also acknowledge that Dreampurse does not have the responsibility of ensuring that You meet all of the aforesaid eligibility requirements.

Please read the terms and conditions carefully before registering, accessing or using Dreampurse Services (defined below) offered through the dreampurse.in website, CRED Wallet (defined below) or through applications or websites of CRED Group Entities (defined below).

Definitions
"Dreampurse", "We", "Us", "Our" means Dreampurse and the CRED Group Entities.

"You", "Yours", "Yourself", "User"means any prospective user, or registered user of CRED Wallet.

"CRED" means Dreamplug Technologies Private Limited, having its registered office at 404 Uphar II CHS Ltd., Plot No.5, BHD Sanjeeva ENCL, 7 Bunglows, Near Juhu Circle, Mumbai, Maharashtra 400 061 and its corporate office at CRED, No. 769 and 770, 100 Feet Road, 12th Main, HAL 2nd Stage, Indiranagar, Bangalore 560038.

"CRED App" means the mobile application(s) hosted by CRED and CRED Group Entities for providing services to the Users and its commercial partners.

"CRED Group Entities"means subsidiaries and affiliates of CRED.

"CRED Platform"means any platform owned / subscribed / used by CRED or CRED Group Entities including but not limited to the CRED App, website, other mobile applications, devices, URLs / links, notifications, chatbots, CRED's social media channels, or any other communication medium or mechanism used by CRED or CRED Group Entities to provide services to the Users.

"CRED Wallet" means the portion of the CRED Platform licensed by Dreampurse from CRED, and used by Dreampurse for providing Dreampurse Services to the Users, including but not limited to the CRED Wallet, Dreampurse Website, other mobile applications, devices, URLs / links, notifications, chatbots, social media channels, or any other communication medium or mechanism used by Dreampurse to provide the Dreampurse Services to the Users.

"Dreampurse Website" means https://dreampurse.in or any other website hosted or registered by Dreampurse.

"Dreampurse Services"means and includes all services offered / to be offered by Dreampurse (including but not limited to the minimum KYC Prepaid Payment Instrument or the Full KYC Prepaid Payment Instrument issued by Dreampurse, and other products / services that may be introduced by Dreampurse thereon from time to time.)
General TnCs and Services
This document is an electronic record in terms of Information Technology Act, 2000 and rules thereunder as applicable and the provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures. By using or attempting to use CRED Wallet, or by checking the tick box, or by clicking on the “I ACCEPT” or “PROCEED” or any other similar button, or by use of any functionality of CRED Wallet, You are consenting to be bound by these TnCs. These TnCs form a legally binding contract between Dreampurse and You for the use of CRED Wallet. You agree and acknowledge that you have read and agreed to these TnCs.

Dreampurse reserves the right, in its sole discretion, to change, amend or otherwise modify the TnCs at any time, without prior notice, and Your continued access or use of CRED Wallet and the Dreampurse Services affirms Your consent of the updated, amended or modified TnCs from time to time. If You object to these TnCs or any subsequent amendment or modification of these TnCs in any way, Your only recourse is to immediately terminate use of CRED Wallet and the Dreampurse Services, for which we request you to initiate the process for closure of Your CRED Wallet. We may require You to agree to additional terms (if any) between You and Dreampurse in connection with specific services that You may avail from us from time to time.

Dreampurse shall make CRED Wallet available to some or all of the Users at its sole discretion. Dreampurse may also suspend or discontinue offering CRED Wallet for any User at its sole discretion.

You agree that:

(a) CRED Wallet provides You access and services through Your account with CRED, and that the Dreampurse Services may be provided to you by virtue of such account. By accessing the Dreampurse Services, you agree to CRED sharing all details / information regarding You and Your CRED account to Dreampurse for Dreampurse to be able to provide the Dreampurse Services to you;

(b) CRED has partnered with Dreampurse to allow Dreampurse to issue and operate wallets (i.e. the CRED Wallet) on the CRED App. CRED is not issuing any prepaid payment instrument directly to You. CRED is only providing its mobile application to Dreampurse for Dreampurse to issue such PPIs in the form of CRED Wallet, and provide Dreampurse Services to You;

(c) You will not use CRED Wallet in a manner that violates any applicable laws or regulations;

(d) You will use CRED Wallet only for personal non-commercial purposes;

(e) all details and information you submit while using CRED Wallet (including while undergoing the KYC process) is true, accurate, current, and complete, and you agree to maintain true, accurate, current, and complete up-to-date information in your account while using CRED Wallet;

(f) You are responsible for maintaining the confidentiality of the access credentials of Your account, and You are fully responsible for all the activities carried out therein, for Your credentials that are used to access Your account and authorise transactions on CRED Wallet, including restricting access to Your device in which You shall be accessing CRED Wallet;

(g) You agree that You are aware and responsible for all transactions taking place through your account. You shall continue to be responsible for the transactions in your account, if you knowingly or negligently (i) grant any other person access to Your account, (ii) permit them to transact on Your account, or (iii) transact on any other person's behalf or directions; whether by sharing one-time passwords or in any other manner;

(h) You will ensure to immediately notify Dreampurse of any unauthorized use of your access to CRED Wallet or any breach of security;

(i) You shall not indulge in decompiling, reverse engineering, disassembling content, removing any intellectual property right associated with CRED Wallet, including our copyright, trademarks, trade secrets, designs, and patents, or other proprietary notices;

(j) You shall not access or use CRED Wallet in any manner that (i) may be harmful to the operation of CRED Wallet or its content; (ii) may be unlawful; (iii) maybe harmful to CRED, Dreampurse, or to any other User; (iv) may hinder the other User's enjoyment of CRED or CRED Wallet; (v) to defraud other Users, CRED, Dreampurse, or any commercial partner; or (vi) launder money.

(k) You shall not post, distribute, or otherwise transmit or make available any software or other computer files that contain a virus, other harmful component or malicious content, or otherwise impair or damage the CRED App, CRED Wallet, or any connected network, or otherwise interfere with any person or entity's use or enjoyment of CRED Wallet.

(l) You shall not delete or modify any content of the CRED app or CRED Wallet.

(m) Your use of CRED Wallet shall indicate that you have provided consent to automatically receive updates such as bug fixes, patches, enhanced functions, missing plug-ins and new versions (collectively, 'Updates'), for the purpose of effective delivery of the Dreampurse Services. Do note that your continued use of CRED Wallet following such Updates would mean deemed acceptance by you of the same.

(q) You understand and accept that not all products, services and rewards offered on CRED Wallet are available in all geographic areas and you may not be eligible for all the products, services and rewards offered by Dreampurse on CRED Wallet or other CRED Platforms. Dreampurse reserves the right to determine the availability and eligibility for any product, services and rewards offered on CRED Wallet or any CRED Platform.

(r) If your device has been lost or stolen, you shall immediately request CRED or Dreampurse to block Your account and change the passcode for the account immediately.

(s) If you decide to delete your CRED Account, you would first be required to close the CRED Wallet, by initiating a closure request as set out herein. You acknowledge that Your CRED Account cannot be closed / deleted without the CRED Wallet being closed first. You also acknowledge that irrespective of the closure of your CRED Account, Dreampurse may be required to retain certain data of Yours as required under applicable laws, and such data will be stored and governed by Dreampurse's Privacy Policy set out in https://dreampurse.in.

(t) You will be allowed to use only one CRED Wallet at any given time. At Dreampurse’s discretion, as a part of this CRED Wallet, you may be provided cashbacks / coupons either directly to Your CRED Wallet or to certain sub- wallets. Dreampurse may impose restrictions on the use-case for which such cashback in the sub-wallets will be redeemable by You, including making them redeemable against only specific merchants. This shall be communicated to You at the time of providing such cashback / coupon.
Issuance of CRED Wallet
(a) You hereby explicitly provide consent to Dreampurse to undertake your KYC verification process, including to link to third parties' portals / webpages in order to search relevant information regarding You and Your KYC. We may conduct KYC through prescribed mechanisms under the KYC Framework and as per our KYC requirements, which may include obtaining information and / or validation of your identity through third party authorised service providers such as but not limited to DigiLocker, Central KYC Records Registry (CKYCR), Unique Identification Authority of India (UIDAI), Protean e-Gov, etc. During this process, you may be required to accept the terms and conditions of such third-party service providers or any other authority whom you authorise to share your Information with us. You hereby provide your express consent to Dreampurse to undertake such KYC, and confirm that all KYC documents procured by Dreampurse during this process are accurate and valid.

(b) Where You choose to undergo minimum KYC for your CRED Wallet, You will be required to provide minimum details such as mobile number verified with a One Time Password, self-declarations of Your name and Your valid KYC records (as required under applicable laws). Upon completion of this minimum KYC, You will be issued a minimum KYC CRED Wallet (i.e. a small PPI / a small KYC CRED Wallet). If you are facing any issues with Your self-declaration process, please reach out to support@dreampurse.in

(c) This minimum KYC CRED Wallet will be subject to lower limits as set out in the section on ‘Payments from CRED Wallet’ below. If You wish to upgrade your CRED Wallet to avail of higher limits, you will need to complete the entire KYC processes set out below. Users with a minimum KYC CRED Wallet must complete the entire KYC process set out below within 2 (two) years of creating the wallet, to enjoy continued use of the CRED Wallet. If such KYC is not successfully completed within this timeline, Dreampurse will not permit any further credits to the CRED Wallet. However, You will be allowed to use the existing balance.

(d) Where You choose to undergo a non-face-to-face KYC verification, You declare and confirm that the address and other details displayed to You during the KYC journey (as fetched from CKYCR, Digilocker, or any other permitted source) are Your correct and up-to-date details, and that you will inform Dreampurse in case of any changes to the same.

(e) Where You choose to undergo a video KYC verification, You agree that:
      1. You will undergo video KYC only when You are physically present in India, and you will attend the video yourself only;
      2. By opting for our video KYC facility, an audio-video call will be initiated between you and a Dreampurse KYC officer for undertaking necessary steps towards completing your full KYC. By initiating the KYC process using video KYC facility, you consent to the terms provided herein. You understand and acknowledge that the availability of the video KYC facility is dependent on the availability of a Dreampurse KYC officer and may be impacted basis availability of other technical stipulations such as any delay, interruption, or failure in network or system connectivity at either end.
      3. Any disruption in the video KYC process may require a fresh session at Dreampurse's discretion and as per RBI guidelines.
      4. You shall maintain a good lighting environment with minimum background noise/disturbances. Dreampurse in its sole discretion may reject the VKYC if it feels that the video call is not clear, is fraudulent, ambiguous and/or is not satisfied with the same for any reasons whatsoever.
      5. By participating in the video KYC process, you consent for Dreampurse to capture, store, and share your live GPS coordinates, audio, video, photographs, screenshots etc. (including your signatures and other information) for the purpose of verifying your identity in connection with the KYC process of your CRED Wallet.
      6. You are strictly prohibited from recording/ using any content of the audio-video call during the Video KYC process and/or publishing it in any form or any manner whatsoever. If you violate any of the applicable terms and conditions, which includes any unauthorized recording and/or publishing of the audio-video call during the Video KYC, then Dreampurse shall have the right to close / suspend your CRED Wallet, including any information, material or content associated with the same, immediately, and take any other action as it deems fit in relation to the CRED Wallet and/or services provided by us, including any legal action.
      7. You confirm and acknowledge that you have provided your valid KYC Documents for verification during the video KYC verification process.
(f) Upon completion of the entire KYC process, Dreampurse may submit your KYC records with the CKYCR in accordance with the applicable RBI guidelines and other applicable laws.

(g) Once you successfully complete the above KYC process in entirety (which may include downloading records from CKYCR, Video KYC verification, liveliness check, physical address verification, PAN check, bank account validation, fraud screening, etc) as required under KYC Framework and Our KYC policy, We will issue you Full KYC reloadable PPI, as visible on the CRED mobile application.

(h) At any point in time, if Dreampurse identifies or is notified of a failure in the KYC verification process, it reserves the right to suspend / close your CRED Wallet, and We may, at Our discretion, re-open the same only upon You furnishing additional details requested by Us.

(i) The CRED Wallet may be loaded by You using such instruments as permitted under applicable laws, as set out in these TnCs.

(j) Users who chose to undergo a non-face-to-face KYC process must complete a full face-to-face video KYC verification within one year of the issuance of the wallet, for continued use of the CRED Wallet, failing which Dreampurse may automatically close your CRED Wallet.

(k) You also agree that if you chose to undergo a non-face-to-face KYC process, Dreampurse reserves the right to require you to undertake a video KYC verification at any point in time at its discretion, and has the right to suspend or permanently stop Your use of the CRED Wallet until the same is complete.

(l) Users who chose to undergo a non-face-to-face KYC process shall also be subject to a maximum loading amount of INR 2,00,000 in a financial year, until they undergo the video KYC verification process.

(m) The CRED Wallet issued to You is valid indefinitely, unless suspended or closed in accordance with these TnCs. This validity period may be modified by Dreampurse at its sole discretion.

(n) You agree to furnish any additional details or information Dreampurse may require from you from time to time.

(o) Where You do not conduct any financial transactions on Your CRED Wallet for a continuous period of 1 (one) year, Dreampurse reserves the right to treat Your CRED Wallet as inactive, and may decide to suspend or close your wallet in accordance with these TnCs. If you wish to reactivate the CRED Wallet, please reach out to support@dreampurse.in.

(p) Issuance of CRED Wallet might be subject to additional due diligence, which may include but not be limited to reviewing and validating the credentials provided by You as part of the Your wallet onboarding journey, internally or using other third party service providers, or conducting any sanctions check as notified by regulators, or as per our risk management processes.

(q) Dreampurse shall have the absolute discretion on whether or not to issue a CRED Wallet to You. You shall not be entitled to become a CRED Wallet holder by merely sharing the required data.

(r) The KYC requirements are defined by the regulator(s) and are updated from time to time and may involve fetching Your KYC data from various sources permitted by the regulator. You authorize Dreampurse to fetch data and agree to the terms and conditions of any KYC service provider and its data sharing terms for providing such KYC data to Dreampurse.

(s) You understand and confirm that Your KYC data provided to Dreampurse may be used for evidentiary purposes, including for submission before regulatory bodies/ judicial or quasi-judicial bodies / auditors/ mediators or arbitrators and you hereby provide your consent to the same.

(t) The features and restrictions (such as loading restrictions, spend restrictions, etc.) of the CRED Wallet are subject to Dreampurse's internal risk assessment, and may be modified at Dreampurse's sole discretion from time to time. We may restrict Your access to Your CRED Wallet or report Your account to LEAs or other regulators. You understand that We may or may not communicate the above action to You. This is part of our transactional risk management practice to keep Your CRED Wallet and ecosystem secure for our users and merchants.
Loading of CRED Wallet
You may load your CRED Wallet by transferring funds from Your bank account via UPI, or by using Your credit card. You agree to use funds from only Your own account while loading the CRED Wallet for the first time. However, you will not be able to use debit cards, cash, or netbanking to add/load amount to your CRED Wallet. No interest will be paid on the amounts loaded and stored in Your CRED Wallet at any point in time.
Payments from CRED Wallet
(a) You may use your CRED Wallet to make payments to certain merchants identified and enabled by Dreampurse. For this, Dreampurse may deploy the services of any other third party payment gateways or payment aggregators.

(b) To enable such transactions, we may be required to share your data with the identified merchants on a need-to-know basis. You hereby provide your express consent to Dreampurse to share such data in accordance with our Privacy Policy.

(c) Where You have opted for a minimum KYC CRED Wallet, Your wallet will be subject to the following restrictions:
      1. The amount loaded on or debited from the CRED Wallet during any given calendar month cannot exceed INR 10,000.
      2. The amount outstanding in the CRED Wallet at any point in time cannot exceed INR 10,000.
      3. The total amount loaded during any given financial year cannot exceed INR 1,20,000.
      4. You cannot use Your minimum KYC CRED Wallet for making payments to an individual via a fund transfer, or make any cash withdrawals from the wallet. You can only use the amounts in Your CRED Wallet for payments to certain merchants identified and enabled by Dreampurse.
      5. If You decide to close your minimum KYC CRED Wallet, or if you have not upgraded to a full KYC Wallet within 2 (two) years from creation of the minimum KYC Wallet, then Dreampurse will allow You to transfer any outstanding balance to your source account after completing any requisite KYC. Post such transfer, Your CRED Wallet will be closed.
(d) Where you have successfully completed your entire KYC as set out above, You may also use Your upgraded CRED Wallet to make payments to individual beneficiaries, subject to them being pre-registered on the CRED Wallet as a beneficiary. For pre-registering these beneficiaries, You will need to provide the correct bank account / recipient account details of such beneficiaries. Dreampurse shall not be responsible for any mistakes made by you while pre-registering beneficiaries, including any payments made by You to such incorrectly registered beneficiaries.

(e) Where you onboarded using non-face-to-face KYC, Your use of the CRED Wallet will be subject to the following restrictions. If you want to upgrade these limits, you will need to undergo the video KYC verification:
      1. The amount outstanding in CRED Wallet cannot exceed INR 1,00,000 at any point of time.
      2. In case of pre-registered beneficiaries, the funds transfer limit cannot exceed INR 2,00,000 per month per beneficiary.
      3. Funds transfer limits for all other cases will be restricted to INR 10,000 per month.
      4. The maximum amount you can load into Your CRED Wallet in a financial year is INR 2,00,000.
(f) Where you onboarded using video KYC, your use of the CRED Wallet will be subject to the following restrictions:
      1. The amount outstanding in CRED Wallet cannot exceed INR 2,00,000 at any point of time.
      2. In case of pre-registered beneficiaries, the funds transfer limit cannot exceed INR 2,00,000 per month per beneficiary.
      3. Funds transfer limits for all other cases will be restricted to INR 10,000 per month.
(g) No cash withdrawal will be permitted at any point in time, to any User.

(h) You agree and acknowledge that Dreampurse is only a facilitator and is not and cannot be a party to or control in any manner any transactions relating to purchase of goods and/or services or any remittances made by You using CRED Wallet.

(i) Dreampurse is not liable / responsible for purchases made by You with any merchant, including any defect in the product / merchandise / goods or services purchased / availed using CRED Wallet. Dreampurse shall not mediate or resolve any dispute or disagreement between you and the banks or merchants. Any such dispute or claim regarding the above must be resolved by You with the relevant merchants or third parties directly.

(j) While making any payments using CRED Wallet, You shall be responsible for ensuring that there are sufficient funds in your account. Dreampurse will not be liable for any insufficiency of funds in your CRED Wallet.
UPI on CRED Wallet
Dreampurse has enabled Unified Payments Interface ("UPI") functionality on CRED Wallet in accordance with the guidelines issued by the Reserve Bank of India (“RBI”) and the National Payments Corporation of India (“NPCI”) allowing You to use Your CRED Wallet balance for UPI based payments and fund transfers via the CRED App (“CRED Wallet UPI”). By registering for and using CRED Wallet UPI, You agree to be bound by these additional terms:

  • (a) CRED Wallet UPI shall be available only to Users who have completed full Know Your Customer (KYC) verification as mandated by RBI. To activate CRED Wallet UPI, You may be required to complete additional verification, consent, or device-binding steps as prescribed by Dreampurse. Upon successful activation, Dreampurse will issue or link a Virtual Payment Address (“VPA” or “UPI VPA”) to Your CRED Wallet. This VPA will serve as Your identifier for sending and receiving UPI payments using Your CRED Wallet balance.

  • (b)By creating a UPI VPA for Your CRED Wallet, You expressly consent to CRED and Dreampurse accessing and relying on the authentication method configured on Your device in order to access the CRED App (such as biometric verification or device/app password or PIN as may be configured by You) for authentication of UPI transactions via the CRED Wallet. You further authorise CRED to initiate SMS from Your device for the purpose of registering and linking Your device to Your UPI VPA in compliance with applicable RBI and NPCI requirements.

  • (c) Once Your CRED Wallet linked UPI VPA is successfully created, UPI transactions from CRED Wallet can be processed without requiring a UPI PIN in compliance with applicable RBI and NPCI guidelines. You can use it to make UPI transactions (such as merchant payments, fund transfers and any other transactions as permitted by NPCI/RBI) and receive funds into Your CRED Wallet using Your UPI VPA. You may pay using the CRED Wallet via UPI while making any payment on the CRED App where it is enabled as one of the eligible payment methods.

  • (d) All transactions through Your CRED Wallet linked VPA will be subject to the limits prescribed by RBI and NPCI from time to time.

  • (e) CRED, Dreampurse, or other participants in the UPI system reserve the right to reject any transaction or block or suspend Your access to any UPI transactions through the CRED Wallet if it is suspected that You are engaging in any manner of fraudulent or unlawful transactions. Dreampurse may suspend, restrict, or terminate Your access to CRED Wallet UPI, with or without notice, in case of any suspected fraud, operational risk, regulatory requirement, breach of these Terms, or discontinuation of the facility. Termination of Your CRED Wallet shall automatically result in the deactivation of Your UPI VPA linked to it.

  • (f) You are responsible for the security of Your credentials for use of CRED Wallet such as device PIN/password, etc. Do not share these with anyone. If You suspect a breach (e.g. credentials lost or device stolen), notify CRED or Dreampurse immediately.

  • (g) You may only use the CRED Wallet and Your UPI VPA linked to the CRED Wallet, lawfully. You shall not use CRED Wallet UPI for any unlawful, fraudulent, or prohibited activity. You acknowledge that all transactions initiated using Your credentials shall be treated as validly authorized by You.

  • (h) In case of grievances or complaints, You may raise a complaint through the in-app support section or via support@dreampurse.in, providing relevant transaction details. Dreampurse will investigate and resolve such complaints in accordance with NPCI and RBI guidelines. If Your complaint is not resolved satisfactorily, You may escalate to the designated Grievance Redressal Officer whose details are provided on the Dreampurse website. In the event that neither CRED nor Dreampurse resolve the issue, You may approach the NPCI. After exercising these options, You can approach the Banking Ombudsman and/or the Ombudsman for Digital Complaints, as the case may be.

  • (i) You authorize Dreampurse to collect, use, process, and share Your personal and transactional data (including Your UPI VPA, KYC details, device information, and transaction logs) with NPCI, regulators, law enforcement agencies, payment system participants, and its service providers as required for enabling CRED Wallet UPI, performing authentication, monitoring fraud, settling transactions, and complying with applicable laws. Such data shall be handled in accordance with Dreampurse’s Privacy Policy and applicable data protection regulations.

  • (j) Dreampurse shall not be liable for any loss, delay, or failure of a transaction arising from network errors, system downtime, incorrect beneficiary details entered by You, unauthorized use of Your credentials, or any act beyond its control.
Closure of CRED Wallet
(a) Once registered for the CRED Wallet, if you want to log out from CRED Wallet, you may do so by logging out of your CRED account.

(b) In case You want to close Your CRED Wallet, You can follow the steps set out in the CRED App for initiating a closure request.

(c) Any balance lying in your CRED Wallet will first be transferred to Your pre-designated bank account before any closure. Further, in case any transaction on the CED Wallet is outstanding / not yet settled at the time of You initiating a closure request, the request will be processed only after such transaction is settled.

(d) After any closure of the CRED Wallet, Dreampurse will retain Your data for as long as required by Dreampurse to comply with applicable Laws. Your data will be stored and governed by Dreampurse's Privacy Policy set out in https://dreampurse.in.

(e) You agree and acknowledge that there can be certain risk-based scenarios when Your CRED Wallet may not be immediately closed but suspended and then eventually closed which is solely based at the discretion of Dreampurse.

(f) You further understand that once Your CRED Wallet is closed, Dreampurse may not be able to reinstate Your CRED Wallet and may sometimes not allow You to create a new wallet as per regulatory directives or based on Dreampurse's internal policies.

(g) If you decide to delete your CRED Account, you would first be required to close the CRED Wallet, by initiating a closure request as set out herein. You acknowledge that Your CRED Account cannot be closed / deleted without the CRED Wallet being closed first. You also acknowledge that irrespective of the closure of your CRED Account, Dreampurse may be required to retain certain data of Yours as required under applicable laws, and such data will be stored and governed by Dreampurse's Privacy Policy set out in https://dreampurse.in.

(h) For any closure request, we may require you to furnish additional information

(including bank account details) and furnish additional KYC details.

(i) You acknowledge that your CRED Wallet shall always be linked to the mobile number you registered it on, and that you shall always continue to maintain the same as an active mobile number issued by Indian telecom service providers. In case you plan to surrender or deactivate this mobile number used to register your CRED Wallet, please ensure you either close the CRED Wallet before surrendering / deactivating, or You update your mobile number with us by reaching out to us at support@dreampurse.in before surrendering / deactivating. Dreampurse shall not be liable for any loss of access to the CRED Wallet due to a failure to do the above.
Fees
We may charge you a fee on certain transactions or the use of CRED Wallet (such as when loading the CRED Wallet with a credit card); where you will be notified of such applicable fees, prior to the completion of any transaction. By clicking 'Proceed' / 'Submit' / 'Continue' or any other similar button on CRED Wallet, You shall be deemed to have consented to the fees displayed on the said page.

As on the date of publishing these TnCs, the fees proposed to be charged by Dreampurse for various transactionsare as follows. Please note that this may change from time to time at Dreampurse's sole discretion, and shall be notified to you on the CRED App before you initiate the relevant transaction.

Refunds
(a) You agree that once you initate a transaction through CRED Wallet, Dreampurse will treat the same as final, and no CRED Group Company shall be responsible for any error and omission by You or merchant partners in such transaction. Such transactions cannot be refunded, returned or cancelled once initiated.

(b) If you erroneously processed a payment to an unintended recipient or processed a payment for the wrong amount (for instance a typographical error at your end), Your only recourse will be to contact the recipient directly.

(c) In case We receive a refund for a transaction which You have processed earlier, We will automatically refund the amounts back to the source account, i.e. the CRED Wallet, unless specified or directed by You otherwise. No refunds will be provided in cash.
Violation Of TnCs / Suspicious Activity
(a) If We believe that you have violated any of the conditions as mentioned under these TnCs, our Privacy Policy, or any agreements consented to via the CRED App / CRED Wallet, we reserve the right to suspend your access to CRED Wallet / CRED App and/or delete your account without prior notice to You. In such cases, the existing balance in the CRED Wallet shall be transferred to the pre-designated bank account (as provided by You).

(b) If you have provided any incorrect or incomplete information / documents / declarations to Dreampurse, whether as part of your KYC verification or otherwise, You agree that Dreampurse reserves the right to refuse activation / to deactivate your CRED Wallet, and to report such incidents to law enforcement agencies or regulators as required under applicable laws. You understand that We may or may not communicate the above action to You.
Prohibited Transactions and Liability of the Customer
(a) You agree to use CRED Wallet features only for the intended purposes and not for money laundering, terrorist financing, illicit payments or any other use which is either prohibited by law or is unethical. (b) You agree that You shall be solely responsible for any unauthorised use of CRED Wallet. (c) In particular you also agree not to use the CRED Wallet feature to pay any amount directly or indirectly for the following good / services:
1. Adult goods and services which includes pornography and other sexually suggestive materials (including literature, imagery and other media); escort or prostitution services; Website access and/or website memberships of pornography or illegal sites;

2. Alcohol which includes alcohol or alcoholic beverages such as beer, liquor, wine, or champagne;

3. Body parts which includes organs or other body parts;

4. Bulk marketing tools which includes email lists, software, or other products enabling unsolicited email messages (spam);

5. Cable descramblers and black boxes which includes devices intended to obtain cable and satellite signals for free;

6. Child pornography which includes pornographic materials involving minors;

7. Copyright unlocking devices which includes Mod chips or other devices designed to circumvent copyright protection;

8. Copyrighted media which includes unauthorized copies of books, music, movies, and other licensed or protected materials;

9. Copyrighted software which includes unauthorized copies of software, video games and other licensed or protected materials, including OEM or bundled software;

10. Counterfeit and unauthorized goods which includes replicas or imitations of designer goods; items without a celebrity endorsement that would normally require such an association; fake autographs, counterfeit stamps, and other potentially unauthorized goods;

11. Drugs and drug paraphernalia which includes illegal drugs and drug accessories, including herbal drugs like salvia and magic mushrooms;

12. Drug test circumvention aids which includes drug cleansing shakes, urine test additives, and related items;

13. Endangered species which includes plants, animals or other organisms (including product derivatives) in danger of extinction;

14. Gaming/gambling which includes lottery tickets, sports bets, memberships/ enrolment in online gambling sites, and related content;

15. Government IDs or documents which includes fake IDs, passports, diplomas, and noble titles;

16. Hacking and cracking materials which includes manuals, how-to guides, information, or equipment enabling illegal access to software, servers, website, or other protected property;

17. Illegal goods which includes materials, products, or information promoting illegal goods or enabling illegal acts;

18. Miracle cures which includes unsubstantiated cures, remedies or other items marketed as quick health fixes;

19. Offensive goods which includes literature, products or other materials that:

20. Defame or slander any person or groups of people based on race, ethnicity, national origin, religion, sex, or other factors;

21. Encourage or incite violent acts;

22. Promote intolerance or hatred.

23. Offensive goods, crime which includes crime scene photos or items, such as personal belongings, associated with criminals;

24. Pyrotechnic devices, combustibles, corrosives and hazardous materials which includes explosives and related goods; toxic, flammable, and radioactive materials and substances;

25. Regulated goods which includes air bags; batteries containing mercury; Freon or similar substances/refrigerants; chemical/industrial solvents; government uniforms; car titles; license plates; police badges and law enforcement equipment; lock-picking devices; pesticides; postage meters; recalled items; slot machines; surveillance equipment; goods regulated by government or other agency specifications;

26. Securities which includes government bonds or related financial products;

27. Tobacco and cigarettes which includes cigarettes, cigars, chewing tobacco, and related products;

28. Traffic devices which includes radar detectors/jammers, license plate covers, traffic signal changers, and related products;

29. Weapons which includes firearms, ammunition, knives, brass knuckles, gun parts, and other armaments;

30. Wholesale currency which includes discounted currencies or currency exchanges;

31. Live animals or hides/skins/teeth, nails and other parts etc. of animals;

32. Multi-Level Marketing collection fees;

33. Matrix sites or sites using a matrix scheme approach;

34. Drop-shipped merchandise;

35. Any product or service which is not in compliance with all applicable laws and regulations whether federal, state, local or international, including the laws of India;

36. The merchants providing services that have the potential of casting the Payment Gateway Facilitators in a poor light and/or that may be prone to Buy & Deny attitude of the cardholders when billed (e.g. Adult material/ Mature content/Escort services/ friend finders) and thus leading to chargeback and fraud losses;

37. Businesses or website that operate within the scope of laws which are not absolutely clear or are ambiguous in nature (e.g. Web-based telephony, Website supplying medicines or controlled substances, website that promise online match-making);

38. Businesses out rightly banned by law (e.g. Betting & Gambling/ publications or content that is likely to be interpreted by the authorities as leading to moral turpitude or decadence or incite caste/communal tensions, lotteries/sweepstakes & games of chance);

39. The merchants who deal in intangible goods/ services (e.g. Software download/ Health/ Beauty Products), and businesses involved in pyramid marketing schemes or get-rich-quick schemes. Any other product or Service, which in the sole opinion of CRED, is detrimental to the image and interests of CRED, as communicated by either of them/ both of them to the merchant from time to time. This shall be without prejudice to any other terms & conditions mentioned in these Terms and Conditions;

40. Bulk marketing tools which includes email, lists, software, or other products enabling unsolicited email messages (spam);

41. Web-based telephony/ SMS/Text/Facsimile services or Calling Cards. Bandwidth or Data transfer/ allied services. Voice process /knowledge process services; and

42. Mailing lists

43. Money laundering services.

44. Database providers (for tele-callers).

45. Bidding/Auction houses.

46. Firms promoting business opportunities, investment opportunities and mortgage.

Privacy
We collect, hold, use and transfer your personal data in accordance with our Privacy Policy. By agreeing to the TnCs, you also hereby agree to our Privacy Policy (available here: https://dreampurse.in), which may be updated and/or modified by us from time to time. You understand and agree that any data provided by you in connection with the Dreampurse Services may be shared with our subsidiaries, affiliates or business partners, or any CRED Group Entity, and/ or used by us for enhancing the Dreampurse Services, in accordance with applicable laws, including but not limited to creating new products. Please refer to the Privacy Policy for further clarity on the subject.
Indemnification
Per the provisions of the TnCs herein, You agree to indemnify, defend and hold harmless Dreampurse, CRED, the CRED Group Entities, and each of their respective directors, officers, owners, employees, partners, members, agents, representatives, co-branders and other applicable third parties (collectively “Indemnified Parties”) from and against any and all claims, demands, damages, causes of action, cost, debt, expenses or liability, including reasonable attorney's fees, incurred by the Indemnified Parties arising out of, related to, or which may arise from: (a) Your use of and access to the CRED App, CRED Wallet, and the Dreampurse Services;

(b) any breach or non-compliance or violation by You of any TnCs or the terms of any third parties involved in provision of Dreampurse Services;

(c) any dispute or litigation caused by Your action or omission;

(d) Your negligence or violation of any applicable laws or right of a third party; including any intellectual property right or privacy right; or

(e) any claim that Your use of the CRED App, CRED Wallet, or Dreampurse Services caused damage to a third party.
Limitations Of Liability
In no event shall Dreampurse, its group entities, their officers, shareholders, subsidiaries, associate companies, directors, employees and agents, partners, co-branders, licensors, licensees, consultant, or contractors be liable to You or any third party for any indirect, special, incidental, punitive or consequential damages, or losses whatsoever, lost data or lost profits, goodwill and/or other intangible loss / opportunity etc., arising out of or in connection with Your usage of or inability to use the Dreampurse Services and/or the CRED App and / or CRED Wallet, Your access to, display of or use of the same or with the delay or inability to access, display or use the same, whether in an action of tort, contract, negligence or other action, and regardless of whether Dreampurse has been advised of the possibility of such damages.

Further, notwithstanding anything contained otherwise, under no circumstance shall the total cumulative liability of Dreampurse and its group entities to You in connection with the Your use of the Dreampurse Services, CRED App, CRED Wallet, or all damages, losses and causes of action (whether arising under contract or otherwise) arising from these Terms of exceed INR 10,000 (Indian Rupees Ten Thousand only).
Governing Law And Dispute Resolution
Any dispute, conflict, claim or controversy arising out of or broadly in connection with or relating to the Dreampurse Services or these TnCs, including those relating to its validity, its construction or its enforceability shall be first raised by the user to support@dreampurse.in. If such Dispute has not been settled within sixty (60) days after the User reaches out to the aforementioned email ID, such Dispute can be referred to and shall be exclusively and finally resolved by arbitration under the Arbitration and Conciliation Act, 1996 (“Act”). Provided, however, when Dreampurse raises any dispute, Dreampurse may directly initiate arbitration in accordance with this clause. The Dispute shall be resolved by one (1) arbitrator to be appointed by Dreampurse. The place the arbitration shall be Bangalore, India. The language of the arbitration shall be English. The existence and content of the arbitration proceedings, including documents and briefs submitted by the parties, and correspondence, orders and awards issued by the sole arbitrator, shall remain strictly confidential and shall not be disclosed to any third party without the express written consent from the other party unless: (i) the disclosure to the third party is reasonably required in the context of conducting arbitration proceedings; and (ii) the third party agrees unconditionally in writing to be bound by the confidentiality obligation stipulated herein.

These User Terms shall be governed and construed in accordance with the laws of India.
Force Majeure
Dreampurse or CRED shall not be liable for any failure or delay to perform any of their obligations if such performance is prevented, hindered or delayed, in part or entirely, by any Force Majeure event beyond the control of Dreampurse (such as war, sabotage, fire, flood, pandemic, epidemic, explosion, earthquake, acts of god, acts of third parties, civil commotion, lock down, strikes or industrial action of any kind, riots, insurgency, acts of government/regulator, breach of computer systems, malfunctioning of computer systems/ servers by any malicious code or virus, mechanical or technical errors/failures, power shutdown, failures in telecommunication or internet services etc.).

Dreampurse reserves the right to withdraw/ suspend the Dreampurse Services so long as the Force Majeure event continues.
Proprietary Rights and Ownership
CRED App, CRED Wallet, CRED Website, CRED logos, the CRED Platform, and the Dreampurse Services are protected by copyright, trademarks, patents, trade secret and/or other intellectual property laws. No information, content or material from the CRED App including, without limitation, all of the page headers, images, illustrations, graphics, audio clips, video clips or text, reports generated, trademarks, tradenames may be copied, reproduced, republished, uploaded, posted, transmitted or distributed in any way without Dreampurse's express written permission. You are hereby given a limited licence to use the CRED App and CRED Wallet, subject to your agreement of these TnCs.

CRED, CRED Group Entities, and its licensors, if any, are the sole owners of the underlying software and source code associated with the CRED App and CRED Platforms as well as any other intellectual property rights of any other nature associated with the CRED App, CRED Platforms, CRED Wallet, and their content.

When you upload, submit, store, send or receive content that may include feedback to or through the CRED App, you give CRED and CRED Group Entities a worldwide, perpetual licence to use, host, store, reproduce, modify, create derivative works, communicate, publish, publicly perform, publicly display and distribute such content. This licence shall not expire even if it is not used by CRED or CRED Group Entities. The rights you grant in this licence are for the limited purpose of operating, promoting, and improving the CRED Services, and to develop new ones. This licence continues even if you stop using the CRED Services.

All information and content including any software programs available on or through CRED Wallet is protected by copyright. You are prohibited from modifying, copying, distributing, transmitting, displaying, publishing, selling, licensing, creating derivative works or using any such content available on or through CRED Wallet for commercial or public purposes.

If You have comments regarding the Dreampurse Services and/or CRED Wallet and / or CRED App or ideas on how to improve it, please contact our customer service. Please note that by doing so, You hereby irrevocably assign to CRED or Dreampurse, as the case may be, and shall assign to CRED or Dreampurse, all rights, title and interests in and to all ideas and suggestions and any and all worldwide intellectual property rights associated therewith. You agree to perform such acts and execute such documents as may be reasonably necessary to perfect the foregoing rights.
Tax Liability
You hereby agree to comply with any and all applicable tax laws in connection with your use of the CRED App, CRED Wallet, Dreampurse Services, including without limitation, the reporting and payment of any taxes arising in connection with payments made through the CRED App, or funds/income received through the Dreampurse Services.
Assignment
You shall not transfer or assign any of Your rights and obligations arising from these TnCs. You agree and acknowledge that Dreampurse may assign or transfer its rights and obligations under these TnCs in whole or in part, to (i) any other CRED Group Entity; (ii) an acquirer of CRED or any CRED Group Entity or their respective equity interest, business or assets; or (iii) a successor entity resulting from any corporate action including mergers or demergers.
Relationship
No joint venture, partnership, employment or agency relationship exists between you, CRED, Dreampurse, CRED Group Entities or any third party as a result of the contract contained in these TnCs.
Severability
If any provision of these TnCs is held to be illegal, invalid or unenforceable, in whole or in part, under any law, such provision or part thereof shall to that extent be deemed not to form part of these TnCs but the legality, validity and enforceability of the other provisions in these TnCs shall not be affected. In that event, Dreampurse shall replace the illegal, invalid or unenforceable provision or part thereof with a provision or part thereof that is legal, valid and enforceable and that has, to the greatest extent possible, a similar effect as the illegal, invalid or unenforceable provision or part thereof, given the contents and purpose of these TnCs.

These TnCs (together with any additional terms displayed in specific sections of the CRED App or CRED Website) constitute the entire agreement and understanding of the parties with respect to its subject matter and replaces and supersedes all prior or contemporaneous agreements or undertakings regarding such subject matter.
Updation
We may amend these TnCs at any time by posting an updated version on the CRED App. The updated version of these TnCs shall supersede the previous version of the TnCs and take effect immediately upon posting.

You have the right to opt-out of agreeing to these TnCs or any future updated version of the TnCs, by ceasing to use CRED Wallet. However, please be aware that your continued use of CRED Wallet and / or the Dreampurse Services from the launch of any updated TnCs would mean deemed acceptance of such updated TnCs including any modification thereof. We recommend you keep checking the TnCs often to be familiar with any updates and changes.

Existing HipBar Wallet users
If you are an existing HipBar wallet user, then:

(a) You may choose to convert the HipBar wallet to a CRED Wallet, and transfer the residual balance from your existing HipBar wallet to the CRED Wallet. For any support with respect to the same, please reach out to us at support@dreampurse.in.

(b) Alternatively, You may choose to close your HipBar wallet and claim a refund of the residual balance through your existing HipBar app or by filling the HipBar Wallet Refund form.
